Summary:Marriage and adultery : a comparative analysis of canonical, Jewish and Muslim criminal law · Modern criminal legislations are based on the principle of the legality of offenses and penalties : the law must provide for the type, content and extent of penalties. The principle of legality binds above all the judges but also the legislator. The theories of attempt, recidivism, extenuating circumstances, reprieve... are well developed. This is the case of the three religious legal systems analyzed in this paper dealing with marriage and adultery.
