Description
Summary:The aim of the essay is to stress the privacy evolution within the EU with regard to the entry into force of the GDPR, starting with its regulatory structure that characterizes this Secondary Law instrument. Initially, in fact, all the safeguards provided for the transfer of personal data to Third Countries to the EU will be brought to light, as they are necessary in order to ensure the lawfulness of such data transfers. Thereafter, account shall be taken of the derogations intended to be implemented in the event that, although the Regulation guarantees are not applied, the criteria established for such derogations established under the GDPR are fulfilled. It is to be noted that, such criteria are characterized by the existence of a legitimate interest through which the GDPR fills the gap in that legal basis: solely provided.
