| Zusammenfassung: | Le don d’organe confronte à la réalité de la maladie, de l’horizon de la mort et d’une effectivité matérielle de la corporéité, et en même temps introduit la possibilité d’un don de soi allant jusqu’à la matérialité de l’organe. Une telle démarche associant don et accès à la réalité corporelle nous conduit à nous interroger sur la relation du sujet à autrui et à lui-même sur le plan moral : jusqu’à quel point peut-on donner un élément constitutif de son corps pour soigner autrui ? La volonté de sauver autrui peut-elle surpasser la recherche de préservation individuelle ? Le don d’organe peut-il s’extraire d’un système de type économique ? Aussi nous proposons tout d’abord de réunir des éléments conceptuels pour penser le don d’organe du vivant, avant de nous concentrer plus précisément sur les implications du don croisé selon les nouvelles dispositions de la loi de bioéthique 2021. Organ donation confronts us with the reality of illness, with the horizon of death and with a material effectivity of corporeality, and at the same time it introduces the possibility of a gift of oneself going as far as the materiality of the organ. Such an approach associating donation and access to the body reality leads us to question the relation of the subject to others and to himself on the moral level: up to what point can one give a constitutive element of one’s body in order to care for another? Can the wish to save others surpass the search for individual preservation? Can organ donation be extracted from an economic system? We propose first of all to bring together conceptual elements for thinking about living organ donation, before focusing more specifically on the implications of cross-donation according to the new provisions of the 2021 Bioethics Law. |
