| Summary: | The Polish concordat dated on the 28th of July 1993 is not being fully respected due to reasons on the side of the Church and the Polish state. First of all, the Church often had violated the primary rule of the independence and autonomy of the Church and state within their domains. It had striven towards gaining influence on the decisions made by the state in particular cases, especially it had tried to influence the process of law making. The concordat had been violated among others in 2010 when the Three Kings Holiday had been made an off work day, and in 2007 by bringing the highest authorities to dismiss the archbishop Stanisław Wielgus from the position of the head of the Warsaw metropolis and by not giving a new statute of the Field Ordinate of the Armed Forces. State authorities had not used all the possibilities given by the 1993 concordat in relations with the Church. In practice the state side does not recall the one sided explanatory declaration linked with the concordat dated on the 15th of April 1997. For the Church the 1993 concordat has a relative character. It recalls the agreements mad mostly in order to maintain the already gained concessions. In the future the Polish concordat should be novelized. |
