| Summary: | The article diagnoses the legal situation and practice of the state’s recognition of religious associations from the first regulatory proposals by the Interim Council of the State in 1916 after an amendment to the law on guarantees of the freedom of conscience and religion of June 26, 1997. An important factor in the regulation and practice of the recognition of religious associations is not the essence of these compounds, but the political and historical factors that determine the behaviour of the state in this matter. Characteristic is the lack of a uniform state policy towards the various religious communities and the lack of consistency of legal solutions in this area. Since 1921 the recognition of religious associations has been anchored as permanently constitutional. However, the detailed arrangements governing the properties of the state authorities for the recognition of religious communities has for decades not been precisely regulated. The article shows the consequences of the lack of regulation of the factual situation in the particular religious associations in historical processes - the interwar period, World War II, and the early post-war years. |
