O artigo demonstracomo o debate sobre o aborto provoca osfundamentos constitucionais da laicidade doEstado brasileiro e expõe a fragilidade da razãopública em temas de direitos reprodutivos,em especial sobre o aborto. | ||
| 520 | |a this article analyses the ethical and legal challenges imposed by anencephaly upon reproductive rights in brazil. the case study is a Supreme Court vote by one of its judges, Cezar Peluso, about the cancellation of the preliminary injunction of anencephaly in october, 2004. brazilian Supreme Court has 11 judges and 7 of them were in favor of the cancellation of the preliminary injunction which authorized women to abort in case of anencephaly in the fetus. the cancellation arguments were basically two: procedural reasons and Christian moral values. the text from judge Peluso was short, but was repre-sentative of the moral argumentation against the right to abort in case of anencephaly in the fetus. this article shows how the abortion debate forces the fundaments of the brazilian secular state and demonstrates the weakness of the public reason to mediate reproductive rights in brazil, mainly abortion. | ||
