Se saisissant de la problématique du changement climatique, les personnes intéressées - particuliers, ONG, acteurs étatiques et infra-étatiques - n'hésitent plus à porter la cause climatique devant les juges afin qu'ils remettent en cause les politiques publiques et les activités privées, condamnent les auteurs des dommages se trouvant à l'origine du changement climatique et prescrivent des mesures préventives et/ou indemnitaires adaptées au combat à mener. Mais qu'en est-il de la prévention des dommages climatiques ? Quel rôle le droit de la responsabilité civile peut-il jouer dans ce domaine ? Les entreprises pourraient-elles demain devenir responsables pour les dommages climatiques futurs ? Le juge pourrait-il leur imposer d'adopter des mesures préventives ? Pourrait-il jouer un rôle, en écho à la dichotomie provenant du régime international du climat, en prescrivant des mesures d'atténuation et d'adaptation ? C'est à ces questions que notre contribution propose de répondre en posant les "Jalons pour une responsabilité civile climatique préventive". Si pour une part, elle s'inscrit dans la continuité de la réflexion menée par la doctrine, à savoir cerner le rôle de la responsabilité civile face au changement climatique, pour une autre part, opérant un changement de cap, elle a pour but d'observer le droit de la responsabilité civile sous le prisme non pas de sa fonction indemnitaire, mais de sa fonction préventive. | ||
| 520 | |a It is now a well-known phenomenon: all around the world, there is a surge in climate change litigation. Stakeholders - private individuals, NGOs, state and sub-state actors - are tackling the issue of climate change and bringing the fight for climate before the courts, in order for them to challenge public policies and private activities, impose sanctions on those who cause harm and, as a result thereof, climate change, and order adequate preventive and/or compensation measures. What about the prevention of climate damage? What role can play the law on tort liability in this regard? Going forward, could companies be held liable for future climate damage? Could the courts order them to adopt preventive measures? Could these courts play a role, echoing the dichotomy that exists in the international climate regime, by ordering mitigation and adaptation measures? These are the questions we will seek to address, by "paving the way for a preventive climate change tort liability". While on the one hand, our work naturally flows from the reflection led by the doctrine, focused on working out the role of tort liability against climate change, on the other hand, operating a shift, our aim is to take a look at the law on tort liability, not through the prism of its compensatory function, but through the prism of its preventive function. | ||
